REGISTRATION OF FOREIGN TENDERERS ON EKAP

In Turkey, procurement transactions are electronically operated on Electronic Public Procurement Platform (EKAP). EKAP has been opened in 2010 and is one of the biggest online platform managed by public entity.

EKAP is defined as “the electronic environment, managed by the Authority, in which the contracting authorities and other stakeholders can conduct the proceedings related with the procurement process via internet” in the Public Procurement Law.

Once EKAP opened, it became mandatory for all contracting authorities to be registered on EKAP. Today, almost 30.000 contracting authorities are registered on EKAP. In 2015, with the amendment in Electronic Procurement Implementation Regulation, it became mandatory for domestic tenderers to be registered on EKAP, and without registration they were not able to participate in procurements. But, it was not mandatory for foreign tenderers to be registered on EKAP and even if they are willing to be registered, since the procedure of the registation of foreign tenderers on EKAP was not regulated, the registration of them could not be done.

Another important amendment has been made in 01.08.2025. With the changes made on this date, registration in EKAP has become mandatory for all natural and legal persons, regardless of whether they are domestic or foreign. Therefore, from this date onwards, foreign natural and legal persons who wish to participate in tenders in Turkey are also required to register in EKAP.

The Public Procurement Authority has also published a guide regarding the registration of foreign natural and legal persons in EKAP. According to this guide, after selecting "Natural/Legal Person" as the Registration Type, "Foreign" must be selected in the Origin field, and the relevant data must be entered in the Potential Tax Identification Number/Foreign Identification Number field. The system checks whether the entered information is registered in the Revenue Administration integration, and if the natural/legal person is registered in the Revenue Administration integration, their name is filled in by the system. If the entered Tax Identification Number is registered in MERSİS or ESBİS, manual addition will not be required. If the relevant record is in the list on the Natural/Legal Person Selection screen, the registration process should be done from the list.
